Sample Cases - Business/Construction/Real Estate Disputes
- Mr. Hadden, in representing the CEO of a local cell phone company, successfully negotiated a settlement on the client's behalf when a large U.S. cell phone carrier improperly attempted to terminate their agreement without paying the monies due under the contract.
- Representation of a woman whose residence had toxic mold and numerous construction defects. After suing the builder of the home, the case settled when the builder agreed to buy the house back from the client "as is" and pay her out-of-pocket damages.
- Mr. Hadden represented a couple who sued the sellers of their home for making fraudulent statements on the sellers' disclosure documents. As a result of the sellers' misrepresentations concerning the lack of prior water/structural damage, the clients had over $100,000 in needed repairs once they moved into the home. Ultimately, the sellers agreed to buy the home back from the client "as is" and pay the clients' out-of-pocket damages.
Sample Cases - Community Associations
- Mr. Hadden was recently retained by a community association to assist with amending all of their governing documents. Specifically, the officers of the association were frustrated by the lack of homeowner compliance with the governing documents. After meeting with the board members and the homeowners, Mr. Hadden drafted numerous changes to the covenants/restrictions, bylaws and the architectural review guidelines.
- After operating for a number of years as an unincorporated association of individuals, a community association approached Mr. Hadden about incorporating, procuring liability insurance and negotiating a sublease of property from a larger association. After attending the various board and homeowner meetings to address all of the parties' concerns, Mr. Hadden worked closely with the officers of the association to incorporate as a non-profit organization, draft initial governing documents, negotiate a contract for a new property manager and purchase the needed insurance for the association.
- Mr. Hadden, in prosecuting numerous lawsuits on behalf of community associations against homeowners for covenant violations, has also successfully defended a variety of counter- suits asserted by homeowners.
Sample Cases - Medical Malpractice/Personal Injury
- Mr. Hadden is currently serving as co-counsel for a family in a federal lawsuit against two hospitals, various doctors and two other health care entities. As asserted in the Complaint, the child was born prematurely as a direct result of the failure to properly treat the mother during the final stages of her pregnancy. The child now has cerebral palsy, and the estimated lost earning capacity and monies needed to care for the child for the remainder of his life are between 10 and 11.8 million dollars.
- Mr. Hadden is currently representing a woman who is permanently disabled as a result of nerve damage in her leg. The client, after being admitted for surgery at a regional hospital, was placed in leg stirrups for several hours without proper repositioning or breaks. Unfortunately, the straps used to hold the client's legs in place were fastened so tightly that severe bruising occurred on the client's thighs. It is estimated that the client's future medical bills and lost earning capacity will exceed 1 million dollars.
- Mr. Hadden is currently representing a client in her medical negligence case against a physical therapy center. As a result of the improper techniques used by the therapist to adjust the client's hip, the client had to undergo major surgery. The client still suffers from debilitating pain, and it is estimated that the lost earning capacity and future medical bills will be over 1 million dollars.
Sample Cases - Securities and Investment Fraud/Malpractice
- Representation of a quadriplegic who deposited over 1 million dollars with the trust department of one of the largest banks in the United States. After the trust monies were negligently depleted, Mr. Hadden brought suit against the bank for breach of fiduciary duty and other causes of action. The bank eventually agreed to settle the case against them.
- Represented a couple against a major Wall Street brokerage firm. In completely ignoring the couple's investment objectives, the broker purchased highly speculative options and borrowed money against their account to make the trades. Ultimately, the couple lost over $500,000 as a result of the unsuitable investments. At mediation, the brokerage firm agreed to settle the case.
- Mr. Hadden represented an elderly woman living on a fixed income whose stockbroker churned the account to generate commissions. As a result of the brokerage firm's total failure to supervise the rogue broker, who was eventually fired from the company, the case settled, and the client's investments were returned to her.
